Divorce Cases in Delhi


Divorce cases in Delhi have touched an alarming rate. Near about 5000-6000 cases are registered in the district court of Rohini. 7000 cases were registered in the month of July alone. According to Amit Verma all the divorce cases occur due to ego problems and ego in economic status. The points related to the divorce cases are discussed below.

Modern lifestyles and professional tensions are one of the reasons for the rising of divorce cases in Delhi. Legal experts believe that more women prefer to file for divorce in Delhi because there are more chances of getting maintenance (compensation) in the city. This is also the reason for the rise of divorce cases in Delhi. According to Anand Sharma, an advocate the court usually decides the amount considering the financial potential of the man, who could have had a well-paid job earlier.

There have been occasions where Delhi courts have instructed the unemployed husbands to pay as much as Rs 30,000 per month as maintenance to their divorced partners. Thus Delhi has emerged as the divorce capital of India. An unemployed man was instructed to pay Rs 30,000 per month to his ex wife as maintenance by the Tis Hazari courts. This instruction was despite the fact that the woman was working in a multinational firm and was earning Rs 100,000 per month.

The court gave the reason that the husband had the potential to earn more as he had earlier worked with a multinational company. in another recent instance, a woman had filed a suit in Delhi high court alleging that her husband had hidden facts related to his income from her. The court accepted her suit and increased her interim monthly maintenance to Rs 1, 25,000 from Rs 40,000 per month. In addition to it, the husband was instructed by the court to provide a new Honda City car with fuel and a driver at his own expense for the day to day maintenance of his ex wife along with 3 children.

According to Kamal Singh, a lawyer who is a specialist in matrimonial disputes most of the women after filing their divorce pleas in other states, transfer their cases at the time of claiming maintenance, as the cost of living in Delhi is high compared to other places.

A total of 2,157 maintenance suits were pending in matrimonial courts in the year 2008, out of which 1,105 were cleared. The pending cases rose to 2,878 as 1,826 fresh cases were filed.

  • Conversion to other religion
  • Incurable mental disorder
  • Incurable leprosy etc

Both the parties could decide to seek divorce by mutual consent. In such a situation, they donít have to disclose the reasons for making such a decision.

Divorce cases in Delhi are on a great rise because of all the reasons and examples discussed above. This has made Delhi as one of the divorce capital not only in India but throughout the world.
